In Plain Language
Before the full terms, here's how the program works:
- Anyone with a ConsentStack account can join. You start at Bronze (15%). Silver (20%), Gold (30%) and Diamond (40%) are by invitation.
- You're credited two ways. Someone creates a workspace within 60 days of clicking your link, or you create a workspace for a client with "This workspace is a referral" switched on. Workspaces for your own business don't count.
- You earn on every paid invoice for as long as the workspace keeps paying and your partner account is active, at the rate you had when the workspace was credited to you.
- Commission waits 30 days in your Stripe account, then you can withdraw it whenever you like. A refund or dispute reverses the commission on that payment.
- You can see your clients' contact emails. Use them only to support those clients, and protect them.
- Market honestly. No misleading claims, no spam, and no bidding on our brand name in paid search.
1. About These Terms
1.1 These Partner Program Terms ("Partner Terms") are an agreement between ConsentStack LLC ("ConsentStack," "we," "us," or "our") and you, the person or business taking part in the ConsentStack partner program ("Partner," "you," or "your"). You accept them by checking "Accept program terms" when you join the program in the dashboard. If you join on behalf of a business, you confirm that you can bind that business to these Partner Terms.
1.2 These Partner Terms add to our Terms of Service, which continue to govern your ConsentStack account and any workspaces you use. If these Partner Terms and the Terms of Service conflict on a matter about the partner program, these Partner Terms govern. Capitalized terms not defined here have the meanings given in the Terms of Service.
1.3 We record which version of these Partner Terms you accepted and when.
2. Joining the Program
2.1 Eligibility. You can join if you have a ConsentStack account in good standing and can form a binding contract.
2.2 Getting paid. We pay commission through Stripe Connect, into a Stripe Express account based in the United States. You can join and earn commission before you connect a Stripe account; it waits until you do. If you can't open a United States Stripe Express account, we can't pay you through the program today.
2.3 Starting tier. Every partner starts at the Bronze tier.
2.4 We may decline or close a partner account that doesn't meet these Partner Terms.
3. Referral Links and Codes
3.1 When you join, you get a referral link carrying your own partner code. You can create additional custom codes and archive codes you no longer use. A link works when it carries one of your active codes, for example consentstack.io/?ref=yourcode.
3.2 An archived code stops crediting new clicks.
3.3 Your codes must not use the ConsentStack name in a way that suggests you are ConsentStack or speak for it.
4. How Referrals Are Credited
4.1 Referral links. When someone clicks your link, we set a cookie in their browser that lasts 60 days. If they create a new ConsentStack workspace in that browser within those 60 days, the workspace is credited to you. If they click more than one partner's link, the last link clicked wins. The credit goes to the first workspace they create after the click. No credit is recorded if they block the cookie, clear it, or sign up in another browser.
4.2 Workspaces you create for clients. When you create a workspace in the dashboard, you can mark it with "This workspace is a referral." A workspace you create and mark this way is credited to you. This covers workspaces you set up for clients, including workspaces an agency creates and holds for its clients, as our Terms of Service allow. It does not cover workspaces for your own business (see Section 5).
4.3 One partner per workspace. A workspace can be credited to only one partner, and is credited when it is created. Workspaces that already exist are not credited later through a referral link.
4.4 Missed or wrong credits. If a workspace you referred wasn't credited to you (for example, because your client signed up in another browser), tell us at [email protected]. We may assign it to you, and if we do, you earn commission from the next invoice paid after the assignment, not on earlier invoices. We may also correct a credit that was recorded wrongly, for example by moving a workspace to the partner who actually referred it. Commission already earned stays with the partner who earned it, unless it came from self-referral, fraud or a breach of these Partner Terms. Our records decide which partner a workspace is credited to.
5. Self-Referrals
5.1 A workspace for your own business, for a business you own or control, or for your own websites is a self-referral. Self-referrals earn no commission, however the workspace was created. Workspaces for your clients' websites are not self-referrals.
5.2 The "This workspace is a referral" switch is on by default when a partner creates a workspace. Turn it off for your own workspaces.
5.3 If we find a self-referral, we may remove the credit and reverse any commission it earned.
6. Commissions
6.1 Rates. Your commission rate is the rate of your tier at the time a workspace is credited to you, and it stays locked for that workspace:
- Bronze: 15%. Every partner starts here.
- Silver: 20%. By invitation.
- Gold: 30%. By invitation.
- Diamond: 40%. By invitation.
6.2 What earns commission. You earn your locked rate on each paid invoice for a credited workspace's ConsentStack subscriptions, including plans and add-ons. Commission is based on the amount the customer actually paid on the invoice, after discounts, promotion codes and account credit, and is rounded down to the cent. An invoice with nothing paid earns nothing.
6.3 Currency. Commission is earned and paid in US dollars, on invoices paid in US dollars.
6.4 What "lifetime" means. There is no end date and no cap. You earn on every paid invoice for a credited workspace for as long as:
- the workspace stays credited to you;
- it keeps paying for a ConsentStack subscription; and
- your partner account is active.
Commission stops if the workspace is deleted or stops paying, if the credit is removed under these Partner Terms, or if your partner account is suspended or closed. Invoices paid while your partner account is suspended earn no commission, and that commission is not paid later.
6.5 Hold. Each commission is held for 30 days from the date the invoice was paid, to cover refunds. After the hold, it is available to withdraw.
6.6 Refunds and disputes. If any part of a payment is refunded, or the customer disputes the payment and the funds are withdrawn, we reverse the whole commission on that payment. If the commission is still in your Stripe balance, we reverse the transfer. If you have already withdrawn it, the amount is deducted from your next withdrawals.
6.7 What never earns commission: self-referrals, workspaces or payments obtained through conduct these Partner Terms prohibit, and invoices paid before a workspace was credited to you.
7. Tiers and Rate Changes
7.1 Silver, Gold and Diamond are by invitation, based on consistent performance and the quality of your referrals. We email you when you move up a tier.
7.2 We may move you to a different tier, including a lower one, and may change the rate of any tier. We will tell you by email at least 30 days before a change that lowers the rate for your future referrals takes effect.
7.3 A new tier or rate applies only to workspaces credited to you after the change. Workspaces already credited to you keep the rate locked when they were credited. For example, when the Diamond rate changed from 50% to 40%, workspaces credited to Diamond partners before the change kept earning 50%.
8. Payouts
8.1 Stripe Connect. Payouts use Stripe Connect Express. You complete a one-time onboarding with Stripe, which verifies your identity and collects your tax and bank details. Stripe's own terms for connected accounts apply to your Stripe account. We do not store your bank or tax details.
8.2 When commission moves. Commission moves to your Stripe balance when the customer pays, or when you finish connecting Stripe for commission earned before that. It stays in your Stripe balance until you withdraw it.
8.3 Withdrawing. After the 30-day hold, you can withdraw your available balance at any time from the partner dashboard. There is no minimum. You can also set an amount (at least $1) at which we withdraw for you automatically; we check once a day. Stripe sends each withdrawal to your bank on its own schedule.
8.4 Settling funds. Part of a balance can still be settling at Stripe after the hold ends, in which case a withdrawal waits until it settles.
8.5 Two-year limit. Stripe requires money held in your Stripe balance to be paid out within two years. We withdraw for you any commission that has been in your Stripe balance for about 700 days.
8.6 Stripe holds. If Stripe pauses payouts on your account (for example, to re-verify your identity), withdrawals wait until Stripe allows them again.
9. Taxes
You are responsible for any taxes on your commission. Stripe collects tax information from you during onboarding, and Stripe or we may issue tax forms (such as IRS Form 1099) where the law requires. We may withhold amounts where the law requires us to.
10. Client Information You Can See
10.1 What you see. For each workspace credited to you, the partner dashboard shows the workspace's name, its plan and whether it has a paid subscription, when it was credited, your rate, the email addresses of the workspace owner and the billing contact, and the commission on each paid invoice with the billing email it was sent to.
10.2 Your duties. You may use this information only to manage your referrals and to support that client. You must:
- not sell it, share it, or use it for unrelated marketing, and not add anyone to a mailing list without their consent;
- protect it with reasonable security and limit it to the people on your team who need it;
- follow the privacy and marketing laws that apply to you;
- delete it when you no longer need it, and when your participation ends; and
- tell us promptly at [email protected] if it is accessed without authorization.
10.3 Workspaces you hold. If you hold a workspace for a client, you are the Customer for that workspace under our Terms of Service and Data Processing Agreement, and you are responsible for having the site owner's authority and for your client's use.
10.4 Our Privacy Policy explains how we handle your own information as a partner.
11. Marketing Conduct
11.1 When you promote ConsentStack, you must:
- describe ConsentStack accurately, using our current published pricing, features and terms;
- not promise legal compliance or particular results, give legal advice in our name, or describe our Compliance Guarantee beyond its published terms;
- not describe ConsentStack as "the cheapest" consent platform, or make price comparisons we haven't published;
- clearly disclose that you earn a commission, wherever you recommend ConsentStack;
- not send spam: message only people who agreed to hear from you or whom the law allows you to contact, and follow the email, text message and privacy laws that apply;
- not bid on "ConsentStack" or variations of it as keywords in paid search, or use them in ad text or display URLs;
- not use cookie stuffing, forced or hidden clicks, pop-unders, or paid or incentivized clicks;
- not list discounts or promotion codes we haven't given you; and
- not suggest you are ConsentStack, part of ConsentStack, or an official reseller, including in domain names, social media handles or account names.
11.2 No white-label resale. You may not rebrand ConsentStack or resell it under another name. Agencies may hold client sites in their own workspaces, invite clients, and include our fees in their own charges, as our Terms of Service allow.
11.3 Our name and logo. We give you a limited, non-exclusive, revocable permission to use the ConsentStack name and logo to promote the program under these Partner Terms. Stop using them if we ask, and when your participation ends.
12. Suspension and Ending the Partnership
12.1 Leaving. You can leave the program at any time by emailing [email protected].
12.2 Suspension. We may suspend your partner account at any time, including while we look into suspected fraud, self-referral or a breach of these Partner Terms. While your account is suspended, your links don't credit new workspaces, invoices paid during the suspension earn no commission, and you can't withdraw.
12.3 Ending. We may end your participation at any time by email. We may end it immediately for fraud, self-referral or a breach of these Partner Terms.
12.4 After it ends. No commission is earned on invoices paid after your participation ends. If it ends for any reason other than fraud, self-referral or your breach, you can still withdraw commission earned before the end date once its hold ends. If it ends because of fraud, self-referral or your breach, you lose unpaid commission connected with it, and we may recover commission already paid for it.
12.5 Your clients. Customers you referred stay ConsentStack customers. Ending your participation doesn't change their workspaces or data. Workspaces you hold for clients stay governed by our Terms of Service.
13. Changes to These Partner Terms
We may change these Partner Terms. We will give you at least 30 days' notice of a material change, by email and in the dashboard, before it takes effect. If you keep taking part after the change takes effect, you accept the new version; if you don't agree, you can leave the program before then. A change never alters the rate locked for workspaces already credited to you, except where these Partner Terms allow us to remove a credit.
14. General
14.1 Independent parties. You and ConsentStack are independent contractors. Despite the name "partner," nothing in these Partner Terms creates a partnership, joint venture, agency or employment relationship. You can't make commitments or statements on ConsentStack's behalf.
14.2 Our records. Commission is calculated from our records and Stripe's. If you think a commission is wrong, tell us within 90 days of the invoice it relates to, and we will review it.
14.3 Terms of Service. The limitation of liability, governing law (California) and dispute resolution (arbitration in Orange County, California) sections of our Terms of Service apply to these Partner Terms.
14.4 Contact. Questions about the program: [email protected].
